What is the Truth In Negotiations Act (TINA) and when is it required?
The Truth in Negotiations Act (TINA) (10 U.S.C. 2306a and 41 U.S.C. chapter 35) requires offerors to submit current accurate and complete certified cost or pricing data when a procurement exceeds the (TINA) threshold of $700,000 and none of the exceptions to certified cost or pricing data requirements applies.
Exceptions to certified cost and pricing data include; existence of adequate price competition, prices that are set by law or regulation, commercial Items, or a waiver granted by the head of the contracting activity for the Government agency.
The purpose of these statutes is to put the Government on equal footing with contractors when negotiating non-competitive, non-commercial, sole-source contracts by giving the Government access to the same pricing information known to the contractor. Failure to provide current, accurate, and complete, certified cost or pricing data may create liability for defective pricing.

What does it cost?
CPM's costs are variable based on the support requested. CPM provides a wide array of support ranging from one-day training seminars to full proposal management. In some cases, our services are allowable as a proposal B&P direct cost, meaning your company will be reimbursed for our costs plus profit.

How are FAR 15 and TINA satisfied?
TINA is satisfied when one or more of the following criteria are met: adequate price competition exists, prices are set by law or regulation, items or services are supported as commercial, the head of the contracting activity for the Government agency grants a waiver, or certified cost and pricing data is analyzed through a Cost Analysis Report or DCAA / DCMA Full Assist Audit. CPM is headquartered in Huntsville, AL and has representatives located in Illinois, Kansas, California, Tennessee, and Virginia. Additionally, CPM has the ability to work virtually and is willing to travel to anywhere to meet our customer's demands.

What is Defective Pricing?
Defective pricing is when inaccurate cost and pricing data has been certified by a contractor to be current, accurate, and complete at the time of final agreement on price. If a contractor fails to comply with TINA and pricing is found to be defective, the U.S. Government has the right to a price adjustment consisting of any overpayment, interest and penalties.
